2. Visiting this website

When you access this website, technically necessary connection and log data are processed. These may include your IP address, date and time, the page requested, browser and device information, referrer information and technical error data.

This processing is necessary to provide the website securely, reliably and without errors. The legal basis is the legitimate interest in operating a secure and functional online service under Article 6(1)(f) GDPR.

This website is hosted through ChatGPT Sites. OpenAI Ireland Limited, 1st Floor, The Liffey Trust Centre, 117–126 Sheriff Street Upper, Dublin 1, D01 YC43, Ireland, processes hosting and usage data as a processor. According to OpenAI, transfers outside the European Economic Area are based on an adequacy decision or the EU Standard Contractual Clauses, as applicable. 3. Cookies, analytics and advertising

Bergstark RacePlan currently does not use its own analytics or marketing services, advertising pixels or newsletter tracking. The hosting platform may use technically necessary cookies or similar storage technologies to provide the website and, for private access, to manage access control. Bergstark RacePlan does not use these technologies for advertising.

4. Contact by email

If you contact us, the contact details and message content you provide are processed to answer your enquiry. If the message concerns steps before entering into a contract or performance of a contract, the legal basis is Article 6(1)(b) GDPR. Other enquiries are processed on the basis of the legitimate interest in responding under Article 6(1)(f) GDPR.

Email communication is handled through Gmail by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. This may involve processing by Google and affiliated companies. Further information: Google Privacy Policy.

5. Orders and payments through Stripe

Stripe is used to process payments. When you open a payment link and complete a payment, Stripe processes contact, billing, payment, device and transaction data. Bergstark RacePlan does not receive your full card or bank-account details, but only the payment information required to confirm, match and process your order.

The legal basis is performance of the contract under Article 6(1)(b) GDPR and compliance with statutory retention and documentation requirements under Article 6(1)(c) GDPR. The payment service provider is Stripe Payments Europe, Limited, Ireland. Stripe also processes certain information under its own data-protection responsibility. 6. Customer questionnaires through Tally

After payment, the ordering process leads to a questionnaire hosted by Tally. The selected package and a Stripe Checkout session number may be transferred to Tally as URL parameters so the response can be matched to the order.

The questionnaire collects the information required for training planning. This may include your name, email address, race or sporting goal, current training volume, available training days, experience, performance data, heart rate, elevation gain, recovery, sleep, symptoms, injuries, illnesses, race fuelling and other information you choose to provide.

General customer and training information is processed because it is required to create and provide the purchased training service. The legal basis is Article 6(1)(b) GDPR.

Health data: Information such as heart rate, symptoms, illness, injury or recovery may constitute special categories of personal data under Article 9 GDPR. It is processed only on the basis of your explicit consent under Article 9(2)(a) GDPR. You may withdraw your consent at any time with effect for the future by email. If essential health data can no longer be processed, it may not be possible to continue the personalised planning or coaching service.

The form service is provided by Tally BV, Sint-Pietersnieuwstraat 11, 9000 Ghent, Belgium. Tally processes form data on behalf of Bergstark RacePlan and states that the data is encrypted and stored in Europe. Further information: Tally and GDPR and Data Processing Agreement.

7. AI-assisted training planning

AI tools provided by OpenAI may be used to structure and evaluate the information supplied and to assist with creating or adjusting training plans. Only information required for the specific planning task is used and, where practicable, it is separated from direct identification and payment data or pseudonymised.

The legal basis is Article 6(1)(b) GDPR. Where health data is processed, this additionally takes place only on the basis of explicit consent under Article 9(2)(a) GDPR. The service provider is OpenAI Ireland Limited, Ireland. According to OpenAI, appropriate safeguards, in particular the EU Standard Contractual Clauses, are used for transfers outside the EEA. No solely automated decision-making: AI is used as an assisting tool. Every training plan is personally reviewed by Harald Feuchter before delivery. No decision based solely on automated processing with legal or similarly significant effects is made within the meaning of Article 22 GDPR.

8. Plan creation, coaching and delivery

The information supplied is processed to create and personally review the training plan, deliver it as a PDF, make agreed corrections and, for the coaching package, provide weekly check-ins, feedback and adjustments. The legal basis is Article 6(1)(b) GDPR and, for any health data contained in these records, additionally Article 9(2)(a) GDPR.

Data is shared only where necessary for the services described, to perform the contract, to comply with a legal obligation or with your consent. Individual training or health data is not sold or used for advertising.

9. Retention periods

• Enquiries that do not lead to a contract: generally for up to six months after the enquiry has been completed.
• Raw data in the Tally questionnaire: generally deleted no later than 30 days after completion of the one-time service or the 8-week coaching period.
• Training plans, check-ins and performance-related communication: generally retained for up to twelve months after completion so that agreed corrections and follow-up questions can be handled; after that, the data is deleted or anonymised.
• Contract, payment and accounting records: retained in accordance with statutory obligations, generally for seven years.
• Records of consent and documents required for legal defence: retained for the duration of any possible legal claims.

Data is retained for longer only where required by law, necessary to establish or defend legal claims, or expressly agreed. It is deleted earlier if the purpose no longer applies and no retention obligation or other lawful ground prevents deletion.

10. Required information

Information marked as required for payment, contact and training planning must be provided in order to enter into and perform the contract. Optional fields may be left blank. Without essential information, it may not be possible to create a sufficiently personalised and reasonably safe training plan.

11. Your data-protection rights

Subject to the applicable legal requirements, you have rights including access, rectification, erasure, restriction of processing, data portability and objection. You may withdraw consent at any time with effect for the future. This does not affect the lawfulness of processing carried out before the withdrawal.
